1. Agreement
These Terms of Service (the “Terms”) govern your access to and use of the InstaYolo website at instayolo.com and the download tools available through it (collectively, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Who we are
InstaYolo is an independent project operated by a small team (referred to in these Terms as “we”, “us”, and “our”). We are not affiliated with, endorsed by, or sponsored by Instagram, Meta Platforms Inc., or any related entity. For legal contact details see the Contact page.
3. The Service
InstaYolo lets you paste a public Instagram URL and receive a direct download of the underlying media file. It is a stateless tool: we do not retain the URLs you paste or the files you receive. We do not host Instagram content; we fetch it from Instagram's CDN at the moment of your request and pass it through to your browser.
The Service is provided free of charge. We may add, change, or remove features at any time without notice.
4. Eligibility
You must be at least 13 years old to use the Service, and at least the age of digital consent in your jurisdiction (for example, 16 in parts of the EEA). By using the Service you represent that you meet this requirement.
5. Permitted use
You may use the Service for personal, non-commercial purposes, including:
- Saving your own posts for backup.
- Saving publicly shared posts for offline viewing.
- Research, journalism, and academic use where that use is lawful in your jurisdiction.
- Creating derivative works where you have the rights to do so under copyright law.
6. Prohibited use
You must not use the Service to:
- Download, or attempt to download, content from private or age-restricted Instagram accounts.
- Circumvent or attempt to circumvent Instagram's authentication, rate limits, or other technical protections.
- Infringe copyright, trademark, publicity rights, or any other intellectual property or personality right.
- Harass, stalk, threaten, impersonate, or defame any person.
- Scrape, mirror, or systematically republish content that belongs to another person without their permission.
- Redistribute, monetize, or commercially exploit third-party content in a way that is not permitted by that content's copyright holder or by applicable fair-use / fair-dealing law.
- Abuse the Service (for example, sending automated or high-volume requests that interfere with normal operation). Rate limits are enforced automatically; attempting to circumvent them is a material breach of these Terms.
- Introduce malware, exploit security vulnerabilities, or interfere with other users.
- Use the Service in any way that violates applicable law.
7. Copyright and your responsibility
Instagram posts are created by the accounts that publish them. Those creators hold the copyright to their work. InstaYolo is a neutral tool for retrieving public media files; it is your responsibility to ensure that your use of any file you download is lawful in your jurisdiction.

8. Our intellectual property
The InstaYolo name, logo, website layout, original text, and source code are our property or used with permission. You may link to the Service; you may not copy, mirror, or rebrand it without our written consent.
9. "As-is" service; no warranties
The Service is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any particular post will be downloadable at any particular time. Instagram's APIs and CDN endpoints change frequently and outside our control.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event will InstaYolo, its operators, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose (which, for a free service, is zero), or (b) US$50.
11. Indemnification
You agree to indemnify and hold InstaYolo and its operators harmless from and against any claim, loss, liability, or expense (including reasonable legal fees) arising out of (a) your use of the Service in breach of these Terms, (b) your infringement of any third-party right, or (c) your violation of applicable law.
12. Changes to the Service and Terms
We may modify the Service or these Terms at any time. Material changes to these Terms will be announced on the homepage for at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, for any reason, without notice — including because of abuse or suspected breach of these Terms. You may stop using the Service at any time; there is no account to close.
14. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service will first be attempted to be resolved informally by contacting [email protected]. If informal resolution fails within 30 days, the dispute will be submitted to the non-exclusive jurisdiction of the Hong Kong courts. Nothing in this section prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction.
15. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and the DMCA Policy, constitute the entire agreement between you and InstaYolo regarding the Service.
